Terms of service - CallOS

This CallOS Terms of Service cum End User License Agreement (“EULA”) is an electronic record in accordance with the provisions of the Information Technology Act, 2000 and the rules made thereunder, including the amended provisions relating to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This Terms of Service cum EULA (“End User License Agreement”) is a legal agreement between CallOS (operated by CallOS) (“CallOS”, “Licensor”, “We”, “Us”, or “Our”), having its registered office at The The First, B/H, Keshav Baugh Party Plot, D-307, near Shivalik Highstreet, Ahmedabad, Gujarat 380015 and You (“Customer”, “Client”, “User”, or “Licensee”), governing your use of the CallOS software platform, including its mobile application, web application, software components, associated media, documentation, and services (collectively referred to as the “CallOS Software”).

By subscribing to, installing, accessing, or otherwise using the CallOS Software, you agree to be bound by the terms and conditions of this Agreement. This Agreement constitutes the complete and exclusive understanding between you and CallOS regarding the Software and supersedes all prior or contemporaneous proposals, communications, representations, or agreements, whether oral or written. If you do not agree to the terms of this Agreement, you must not subscribe to, install, access, or use the CallOS Software.

The CallOS Software is protected by applicable intellectual property laws, including but not limited to copyright laws and international treaties. The Software is licensed to you and not sold. All rights not expressly granted under this Agreement are reserved by CallOS.

1. Introduction

Welcome to CallOS. By accessing or using our platform (mobile application and web dashboard), you agree to comply with and be bound by these Terms & Conditions.

2. User Account
  • Users must provide accurate and complete information during registration.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • Any activity under your account is your responsibility.
3. Subscription & Billing
  • CallOS operates on a subscription-based model (per user/month).
  • Subscription must be renewed before expiry to avoid service interruption.
  • Payments once made are non-refundable unless stated otherwise.
  • Failure to renew may result in restricted access or data suspension.
4. Call Data & Usage

The application collects and processes:

  • Call logs
  • Call duration
  • Contact details (if permitted)

Data is used for:

  • Analytics
  • Opportunity tracking
  • Performance insights

Users must ensure they have legal rights to use and process such data.

5. Call Recordings
  • Users must manually select the recording folder to enable access.
  • CallOS does not automatically record calls.

Users are responsible for:

  • Obtaining consent before recording calls
  • Complying with local laws
6. Permissions

To function properly, the app requires:

  • Call log access
  • Phone state access
  • Storage access

Denying permissions may limit functionality.

7. Data Privacy
  • User data is stored securely and used only for intended purposes.
  • CallOS does not sell user data to third parties.
  • Data may be processed for improving services and analytics.
8. Service Availability
  • We aim to provide uninterrupted service but do not guarantee 100% uptime.
  • Temporary downtime may occur due to maintenance or technical issues.
9. User Responsibilities

Users agree not to:

  • Use the app for illegal activities
  • Misuse call data or violate privacy laws
  • Attempt unauthorized access to the system
10. Account Suspension / Termination

CallOS reserves the right to:

  • Suspend or terminate accounts for:
    • Violation of terms
    • Non-payment
    • Misuse of the platform
11. Delete Account
  • Users may request account deletion at any time.
  • Upon deletion:
    • All associated data may be permanently removed
12. Limitation of Liability

CallOS is not liable for:

  • Data loss due to device issues
  • Incorrect analytics due to incomplete permissions
  • User misuse of the platform
13. Updates to Terms
  • Terms may be updated from time to time.
  • Continued use of the app implies acceptance of updated terms.

This legal document is an electronic record in accordance with the provisions of the Information Technology Act, 2000 and the applicable rules thereunder, including the amended provisions relating to electronic records under various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This legal document is published in compliance with Rule 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, under the Information Technology Act, 2000, as amended by the Information Technology Amendment Act, 2008. It outlines the privacy policy governing access to and use of the CallOS web platform, mobile application, software products/solutions, services, and other integrated systems (“CallOS”).

By accessing or using CallOS, you expressly agree and acknowledge that you are bound by the terms of this Privacy Policy. References in this policy to “we”, “us”, “our”, “platform”, “website”, “application”, “products/solutions”, or “services” refer to CallOS and its integrated systems, while “you” refers to any user of CallOS.

CallOS is a business productivity and communication intelligence platform available through both mobile and web applications. It is designed to track, manage, audit, and analyze call activities of business communication systems used by organizations and their teams. The platform consists of two main components:

  • Mobile Application
  • Web Application

Upon installation of the CallOS mobile application on a device authorized by an organization, the application may access certain data including contacts, call logs, device information, location data (where applicable), and related communication activity strictly for business monitoring and analytics purposes.

Through the web application, authorized users can access detailed insights into team communication, including call logs, call audits, transcriptions, and performance analytics. CallOS enables organizations to centralize communication data, improve team productivity, ensure accountability, and make informed business decisions through actionable insights.

This Privacy Policy applies to all users of CallOS, including but not limited to customers, employees of customers, administrators, agents, and any other authorized users.

By accessing, browsing, registering, or using CallOS, including clicking “I Agree” or similar consent mechanisms, you confirm that you have read, understood, and agreed to the terms outlined in this Privacy Policy and consent to the collection, use, and processing of your information as described herein.

1. Information We Collect
1.1 From the Mobile App (Salesperson Device)

Depending on permissions granted, CallOS may collect:

  • Call logs (incoming, outgoing, missed)
  • Call duration and timestamps
  • SIM information (SIM1 / SIM2)
  • Contact name (if available on device)
  • Device information (model, OS version)
  • App usage analytics
  • Network and performance data

We do NOT collect:

  • Personal messages
  • Photos or media files
  • Browsing history
1.2 From the Web Admin Panel

We may collect:

  • Admin login credentials (securely stored)
  • Device and IP information
  • Activity logs (actions performed within the platform)
1.3 Optional Data

If enabled by the organization:

  • Notes or tags added to call logs
2. How We Use the Data

We use collected data to:

  • Provide call analytics and history to authorized users
  • Improve system performance and reliability
  • Offer customer support
  • Manage subscriptions and licensing

We do NOT sell, trade, or rent personal data.

3. Legal Basis for Processing

We process data based on:

  • Legitimate business interests
  • Contractual agreements with organizations
  • Employee/user consent (as per applicable laws)
4. Data Sharing

We may share data with:

  • Cloud infrastructure providers
  • Analytics and monitoring tools

We do NOT sell data to advertisers or third parties.

5. Data Retention

We retain data:

  • As long as the organization is an active customer
  • Or until data is deleted by the admin

Admins have full control to delete data anytime.

6. Data Security

We implement industry-standard security measures:

  • Encryption in transit (HTTPS)
  • Secure APIs
  • Role-based access control
7. Choice & Control

Users can manage information through:

  • App settings and permissions
  • Organization admin panel (for account management)
  • Support team requests
8. Changes to Privacy Policy
  • We may update this policy periodically.
  • Continued use of the platform constitutes agreement to the updated policy.

Partner Policy
Partner Policy - CallOS Affiliate Program

By joining and registering in the CallOS Affiliate Program (the “Program”), you (“Affiliate”, “You”) agree to be bound by the following Terms and Conditions (the “Terms”). Please read them carefully before registration.

CallOS (“We”, “Us”, “Our”) reserves the right to update, modify, or change these Terms at any time without prior notice. Any updates, enhancements, or new features introduced to the Program shall automatically be subject to these Terms. Continued participation in the Program after such changes constitutes your acceptance of the revised Terms.

1. Account Registration

To enroll in the Program, you must:

  • Provide your legal full name, valid email address, and any other required information.
  • Ensure that all details submitted are accurate and up to date.

Failure to provide accurate information may result in suspension or termination of your account.

2. Referral Leads Process

Upon successful registration:

  • You will be provided access to a lead submission system (such as forms or dashboards).
  • You must submit complete and accurate lead details, including: Name, Contact Number, Company Name, Valid Email Address.

You are solely responsible for the accuracy and authenticity of the submitted data.

3. Qualified & Ineligible Referrals

CallOS will determine, at its sole discretion, whether a referral qualifies for commission.

Ineligible referrals include:

  • a. Existing Customers: Any referral who is already a CallOS customer prior to submission.
  • b. Existing Opportunities: Leads already present in the CallOS database or engaged in an active sales process within the last 90 days.
  • c. Self-Referrals: Referring yourself, your own company, or entities where you are employed or have ownership. Such actions may result in termination and forfeiture of commissions.
  • d. One-Off Services: No commission will be paid for Implementation, Support, Customization, Training, Consulting, or Third-party services. Only net recurring subscription revenue qualifies for commission.
  • e. Late or Missing Lead Submission: No commission will be paid if lead details were not submitted prior to purchase or if the lead was not registered before joining the Program.
  • f. Failure to Follow Process: Any referral not submitted as per defined process will be disqualified.
4. Affiliate Responsibilities
  • You may not negotiate pricing, terms, or commitments on behalf of CallOS.
  • You must follow ethical marketing practices at all times.
  • Use of spam, misleading claims, or unauthorized promotions is strictly prohibited.
5. Promotion Guidelines
  • You may not use the CallOS brand, website, or identity in bulk emails or spam campaigns without prior written consent.
  • Any spam complaints may lead to immediate termination from the Program.
6. Referral Fees & Commission
  • Affiliates will earn 10% commission on successful referrals.
  • Commission applies only to net subscription revenue (excluding taxes).
  • The referred customer must sign up and subscribe within 90 days of lead submission.
  • Commissions are only valid for leads submitted in advance.
7. Payment Terms
  • Referral fees are paid quarterly via bank transfer only.
  • You must provide valid banking details.
  • No payments will be made via Cash, Cheque, or Credit card.

Important Conditions:

  • Commission is paid only after full payment is received from the customer.
  • No commission for: Refunded payments, Chargebacks, or Fraudulent transactions.

CallOS reserves the right to:

  • Delay payments for verification, risk checks, or compliance (including AML checks).
  • Adjust commissions based on actual received revenue.
  • Reject commissions from suspicious or unethical practices.
8. Customer Ownership

All referred customers are considered customers of CallOS. CallOS retains full control over pricing, sales process, customer service, and policies. CallOS is not responsible for any misrepresentation made by affiliates.

9. Pricing & Availability
  • Service pricing is determined solely by CallOS.
  • Prices and availability may change at any time without notice.
  • While we strive for accuracy, we do not guarantee pricing or availability at all times.
10. Termination

CallOS reserves the right to suspend or terminate your affiliate account at any time and refuse participation for any reason.

Termination may result in:

  • Account deactivation
  • Loss of access
  • Forfeiture of pending or earned commissions (especially in cases of fraud or misconduct)
11. Notice

All notices must be sent to: support@callos.in. We will communicate with you via your registered email address.

Notice shall be deemed received within 24 hours of email transmission. Proof of sending an email shall be considered valid proof of delivery.

12. Acceptance of Terms

By registering for the CallOS Affiliate Program, you confirm that you have read and understood these Terms, agree to comply with all conditions stated herein, and accept all future updates and modifications.
